Out of those two, the correct answer would be "he is out of the office." The reason we use the definite article "the" here is because we're referring to one specific office (the one where John works).

Usually we would say he is not in the office right now or he is away at the moment. If you ask to choose between the 2 answers, 2) would get the information across to the other person.
